TERMS AND CONDITIONS OF USE OF THE WEBSITE (sfougara.gr) Updated: July 24, 2026 Welcome to sfougara.gr (hereinafter the «Platform»). Please read the following Terms and Conditions of Use (hereinafter the «Terms») carefully before using the Platform. Browsing, registering, or using the Platform in any way constitutes your full and unconditional acceptance of these Terms. 1. Definitions & Nature of the Platform Administrator: The creator and administrator of the Platform (an individual). Artist: A registered individual or legal entity who creates a profile for the purpose of receiving tips. Viewer / Audience: A visitor to the Platform who accesses it without being required to create a permanent account for the purpose of sending a tip to an Artist. Nature of the Service: sfougara.gr is exclusively a technical platform (SaaS) that connects artists and audiences. The Administrator does not operate as a banking institution, payment institution, guarantor, or money transfer intermediary. 2. Account Creation & Artist Verification To receive tips, the Artist is required to create an account, providing their real full name (as well as their stage name, if they wish). The Administrator reserves the right to request identification information in order to approve and verify the profile as «authentic». Verification is intended solely to prevent identity theft and does not constitute a guarantee of the quality, legality, or content of the Artist’s services. The use of false information, offensive, illegal, or misleading names is strictly prohibited. 3. Viewer Login (Audience) Viewers are not required to create a permanent account. When they access the Platform, they are assigned a random temporary username, which is stored locally via cookies. This name is not unique. Whether the name is retained depends on the cookie settings of the viewer’s browser. 4. Financial Transactions & Disclaimer The Platform does not collect, hold in its own account, or manage tip funds. Transactions take place directly between the Viewer and the Artist in the following ways:: Via Stripe: The integration is carried out through the Administrator’s Stripe Connect infrastructure. Funds are transferred directly to the Stripe account selected and linked by the Artist (e.g., their sole proprietorship or the business they work for). Confirmation is automatic. The account holder is responsible for paying Stripe’s applicable fees, while the Platform does not charge any fees of its own. Via IRIS: The transaction takes place directly between the bank accounts of the Viewer and the one designated by the Artist. Confirmation of receipt of the tip is done manually by the Artist. Transaction Disclaimer: The Administrator bears absolutely no liability for failed transactions, chargebacks, fraudulent transactions, or the Artist’s refusal or failure to manually confirm a receipt via IRIS. Any dispute that arises shall be resolved exclusively between the Viewer, the Artist, and the respective payment provider (Bank / Stripe). 5. Refund Policy Tips are voluntary contributions made by the Audience to the Artist during live performances and there is no receipt for them. The Platform is not involved and bears no responsibility for refunds in the event of a performance cancellation, poor performance quality, or a change of mind on the part of the Viewer. Any refund request concerns exclusively the relationship between the Viewer and the Artist. 6. Users’ Tax and Legal Obligations The Platform provides only the technical infrastructure. Any income derived from tips is the sole tax and legal responsibility of the recipient (Artist). The Artist and their employing business are solely responsible, on a case-by-case basis, for reporting this income to the relevant tax authorities (e.g., AADE), issuing any required legal documents (if applicable), and complying with the applicable legal and tax framework. The Administrator does not provide tax advice and bears no responsibility for any tax violations committed by users. 7. Limitation of the Administrator’s Liability The Platform is provided “as is” and “as available.” The Administrator does not guarantee the uninterrupted or error-free operation of the Platform, nor the availability of third-party systems (Stripe, IRIS banking systems). The Administrator is not liable for any indirect, actual, or consequential damages (including loss of profits) that may result from the use of or inability to use the Platform. 8. Personal Data & Cookie Policy (GDPR) The Administrator respects users’ privacy and complies with applicable data protection laws (General Data Protection Regulation—GDPR). Artist Information: During registration and the verification process, the Artist provides their full name and, if requested, identification documents. Verification of the authenticity of the Artist’s account is conducted exclusively through direct communication (e.g., via official social media accounts or other communication channels). This information is used solely to verify the authenticity of the account and prevent fraud. They are not shared with third parties and are not stored on a server. Viewer (Audience) Data: The Platform does not collect, store on its own servers, or process the personal data of Viewers who log in without an account. Cookie Policy: Technically necessary cookies are used to ensure the proper functioning of the Platform and to assign and maintain the Viewer’s temporary (random or modified) name. These cookies are stored locally on the Viewer’s device. The Viewer may delete them at any time or change their browser settings; however, doing so will result in the loss of their temporary name on the Platform. Third-Party Providers (Stripe): For the processing of payments via Stripe, users are subject to Stripe’s own terms of use and privacy policy. The sfougara.gr platform does not access, store, or process sensitive banking data or credit/debit card information. 9. Amendment of Terms The Administrator reserves the right to amend or update these Terms at any time, without prior notice to users. Users are solely responsible for periodically visiting this page to stay informed of any changes. Continued use of the Platform following any amendment to the Terms constitutes full and unconditional acceptance of the new terms of use. The date of the last update will always be listed at the end of this document. 10. Governing Law & Jurisdiction These Terms are governed by Greek law. Any dispute arising out of or in connection with the use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Administrator’s registered office or place of residence.
